Agreement and the Valtheryn Service

These Terms are an agreement between you and the person or entity responsible for providing and operating the Valtheryn Service. For simplicity, that provider is referred to throughout these Terms as “Valtheryn,” “we,” “us,” or “our.”

“Service” means the Valtheryn website, browser-based game, player accounts, communications we operate, virtual items and currency, payment features if enabled, support systems, and related services available through valtherynlive.com.

Valtheryn is operated from Indiana, United States. These Terms do not represent that Valtheryn is organized as an LLC, corporation, partnership, or other registered business entity unless that status is expressly stated in a future version of these Terms.

Eligibility and minors

• You must be at least 13 years old to use the Service. Valtheryn is not directed to children under 13.
• If you are between 13 and the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms and supervise your use.
• Only an adult with legal capacity—or a minor using an authorized payment method with a parent or guardian’s permission—may make a purchase if paid purchases are offered.
• You may not use the Service if prohibited by applicable law or if we previously terminated you for a serious or repeated violation.

If we learn that an account belongs to a child under 13, we may suspend the account and delete associated personal information as required by applicable law.

Accounts and account security

• Provide accurate registration information and keep it current.
• Keep your credentials confidential, use a unique password, and promptly report suspected unauthorized access.
• You are responsible for activity performed through your account to the extent permitted by law.
• Accounts are personal. You may not sell, rent, transfer, sublicense, or commercially exploit an account.
• You may not create or coordinate accounts to evade enforcement or manipulate battles, rankings, rewards, rallies, trades, events, or other game systems.
• You may not knowingly permit another person to use your account in a way that violates these Terms.

Limited license

Subject to these Terms, Valtheryn grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for lawful, non-commercial entertainment.

This license does not transfer ownership of the Service, software, game data, Virtual Content, or intellectual property.

You may not copy, distribute, publicly perform, scrape, reverse engineer, bypass access controls, derive source code from, or create unauthorized derivative works from the Service except to the limited extent such a restriction is prohibited by applicable law.

Player conduct and fair play

You agree not to:

• Use bots, automation, scripts, macros, unauthorized clients, packet manipulation, cheats, exploits, or tools that provide an unfair advantage.
• Exploit a bug, duplicate resources or Virtual Content, interfere with authoritative game state, or intentionally conceal an exploit while using it for advantage.
• Coordinate alternate accounts, sham transactions, staged battles, fraudulent rallies, resource funneling, fraudulent chargebacks, or other conduct designed to manipulate progression, events, rankings, or rewards.
• Harass, threaten, stalk, defame, discriminate against, sexually exploit, dox, or impersonate another person.
• Post unlawful, infringing, obscene, deceptive, malicious, or privacy-invasive content.
• Attempt unauthorized access, probe or attack the Service, distribute malware, overload infrastructure, evade security controls or rate limits, or interfere with another user’s access.
• Use the Service for gambling, money laundering, unauthorized real-money trading, sale of Virtual Content, or unlawful commercial activity.
• Misrepresent payment authorization, intentionally abuse refunds or disputes, or submit knowingly false support, fraud, security, or copyright reports.

Names, messages, and other user content

You retain any rights you have in content you submit, such as Warden names, settlement names, alliance names or tags, messages, feedback, and support submissions (“User Content”).

You grant Valtheryn a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, transmit, format, moderate, and remove User Content only as reasonably necessary to operate, secure, administer, promote, and improve the Service or comply with law.

You represent that you have the rights necessary to submit your User Content. In-game names, alliance information, rankings, map-visible information, and communications intentionally shared with other users should not be considered private.

We may remove or restrict content that violates these Terms or creates legal, safety, security, moderation, or operational risk.

Suggestions and feedback may be used to improve or develop Valtheryn without compensation, provided we do not publicly identify you as the source without permission.

Live-service operation and game changes

Valtheryn is an evolving online game. We may patch bugs, add or remove features, rebalance troops, Guardians, gear, research, rewards, Virtual Content, maps, events, timers, progression systems, or economies, and perform maintenance when reasonably necessary for gameplay, balance, security, legal compliance, technical operation, or continued development.

We do not guarantee uninterrupted access, permanent availability of a specific feature, a particular competitive outcome, or that the Service will always remain unchanged.

We will not intentionally use this section to avoid delivering a completed paid transaction or to disregard consumer rights that applicable law does not permit us to waive.

Authoritative server records control game outcomes, ownership, resources, troop state, purchases, rewards, and event results, subject to correction of documented errors, fraud, exploits, duplicate grants, synchronization failures, or data corruption.

Virtual currency and virtual content

Gems, resources, troops, gear, Guardians, manuscripts, speedups, protection items, titles, cosmetics, accounts, rewards, and other in-game benefits are collectively “Virtual Content.”

Virtual Content is licensed for use within Valtheryn rather than sold as personal property and has no cash value, ownership interest, or right of redemption for money except where applicable law expressly requires otherwise.

• Virtual Content may be used only inside the Service under current game rules.
• You may not sell Virtual Content, exchange it for real-world money, transfer it outside authorized game systems, or use it as financial collateral.
• Displayed balances are not bank deposits, stored-value accounts, cryptocurrency, securities, or legal tender.
• If paid Virtual Content becomes available, it remains subject to ordinary game limits, eligibility requirements, anti-abuse controls, and disclosed gameplay rules.
• We may correct erroneous, duplicated, unauthorized, refunded, reversed, exploited, or fraudulently obtained Virtual Content.
• If Valtheryn eventually closes, access to Virtual Content may end. Where reasonably practicable, advance notice will be provided. Nonwaivable consumer rights remain unaffected.

Purchases, Stripe, pricing, and taxes

Valtheryn may offer optional paid digital packages in the future. Paid checkout may remain unavailable or be marked “Coming Soon” until production payment processing is enabled.

If paid packages are made available, they may contain Virtual Content clearly identified at checkout, such as gems, speedups, protection items, resources, cosmetics, or other permitted digital benefits. The package description and price presented when you confirm the order govern that transaction, subject to correction of an obvious technical or pricing error before fulfillment.

• Payments may be processed through Stripe. Stripe’s terms, privacy practices, and payment-processing requirements also apply to its services.
• You authorize only the charge displayed at checkout and represent that you are authorized to use the selected payment method.
• Prices are shown in the currency identified at checkout.
• You may be responsible for applicable taxes, bank charges, currency-conversion fees, or internet charges where applicable.
• A payment is not complete until payment is successfully confirmed and the corresponding Valtheryn entitlement or order is recorded.
• A pending card authorization or incomplete Checkout Session does not establish successful delivery.
• Valtheryn does not impose a subscription or recurring charge unless the specific checkout clearly identifies it as recurring before purchase and you separately authorize it.
• We may impose reasonable purchase limits, delay delivery for fraud review, reject suspicious transactions, or require verification reasonably necessary to protect users and the Service.

Never send Valtheryn your complete payment-card number, card security code, or online-banking credentials. Payment credentials entered through Stripe-hosted checkout are handled by Stripe rather than the Valtheryn support system.

Refunds, reversals, and billing problems

If paid digital packages become available, completed and correctly delivered purchases are generally final except where a refund is expressly offered, required by applicable law, or appropriate because of duplication, unauthorized use, incorrect fulfillment, or a verified technical failure.

Contact support@valtherynlive.com promptly regarding a billing issue. Include the Valtheryn order reference and relevant details, but never email your complete card number or card security code.

• We may investigate and, where appropriate, refund, replace, correct, or re-deliver the affected entitlement.
• During a genuine payment dispute, related premium delivery or additional premium transactions may be restricted while the matter is reviewed.
• If a payment is refunded, reversed, or charged back, we may remove corresponding unused or reasonably traceable Virtual Content when appropriate and permitted by law.
• We will not remove unrelated Virtual Content merely to punish a good-faith billing dispute.
• Intentional payment fraud, fraudulent chargebacks, or repeated payment abuse may result in purchase restrictions, account restrictions, or termination.
• Nothing in these Terms limits refund, cancellation, or consumer rights that applicable law does not permit to be waived.

Investigations, suspension, and termination

We may investigate suspected violations using game records, audit logs, payment status, reports, account records, and other relevant evidence.

We may issue warnings, reverse exploited gains, remove prohibited content, restrict features, suspend accounts, or terminate accounts when reasonably necessary to enforce these Terms, protect users, preserve game integrity, prevent fraud or abuse, or comply with law.

Severe security threats, fraud, exploitation, attacks on the Service, or imminent harm may require immediate action.

Where reasonably appropriate, we will provide the general reason for an enforcement action and an opportunity to request review through support@valtherynlive.com. We may withhold sensitive anti-abuse or security details when disclosure would enable circumvention or compromise another person’s privacy or security.

You may stop using the Service at any time and may request account deletion as described in the Privacy Policy.

Termination ends your license and access to Virtual Content, subject to applicable law. Provisions that by their nature should survive termination—including payment records, intellectual-property provisions, disclaimers, liability limitations, dispute provisions, and indemnity obligations—continue to apply where appropriate.

Intellectual property

The Service and its software, original designs, art, characters, lore, text, audiovisual materials, code, logos, branding, and game data are owned by or licensed for use in connection with Valtheryn and are protected by applicable intellectual-property laws.

“Valtheryn” and related branding may not be used to falsely imply sponsorship, affiliation, ownership, partnership, or endorsement.

If you believe material available through Valtheryn infringes your copyright or other intellectual-property rights, contact support@valtherynlive.com and provide enough information to identify the protected work, locate the disputed material, explain the claimed infringement, and allow us to contact you.

We may request additional information reasonably necessary to evaluate and respond to the report.

Third-party services and links

The Service may rely on third-party services such as Stripe, WordPress-related infrastructure, web hosting, domain services, email providers, security services, and linked websites.

Third-party services operate under their own terms, privacy practices, availability commitments, and technical systems.

We are not responsible for third-party content, independent acts, or outages outside our reasonable control. This provision does not excuse obligations that applicable law places on Valtheryn regarding providers we select or information under our control.

Disclaimers

Some jurisdictions do not permit certain warranty exclusions. Where such restrictions apply, this section applies only to the maximum extent permitted by applicable law.

Limitation of liability

To the fullest extent permitted by law, aggregate liability arising from or relating to the Service will not exceed the greater of (a) the total amount you paid directly through Valtheryn during the twelve months before the event giving rise to the claim, or (b) US $100.

These limitations do not apply where liability cannot legally be excluded or limited, including where applicable liability for fraud, willful misconduct, or certain personal injuries.

Your payment-card issuer and applicable consumer-protection laws may provide rights in addition to these Terms.

Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Valtheryn and persons or service providers acting on its behalf from third-party claims, damages, judgments, losses, and reasonable costs arising from your unlawful conduct, your User Content, your infringement of another person’s rights, or your material breach of these Terms.

This obligation does not apply to the extent a claim results from Valtheryn’s own unlawful conduct, negligence, or breach where such responsibility cannot lawfully be shifted to you.

Indiana law and dispute resolution

Before filing a lawsuit, you and Valtheryn agree to make a reasonable good-faith attempt to resolve the dispute informally. A written description of the issue and requested relief may be sent to support@valtherynlive.com.

The parties will ordinarily allow up to 30 days for informal resolution unless immediate relief is reasonably necessary to prevent harm, preserve rights, or comply with a legal deadline.

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles, except to the extent another jurisdiction’s nonwaivable consumer-protection law applies.

Subject to any nonwaivable consumer venue or jurisdiction right, disputes not resolved informally may be brought before a court of competent jurisdiction in Indiana or another court that applicable law requires or permits.

Either party may bring an eligible individual claim in small-claims court.

To the fullest extent permitted by applicable law, claims should be pursued on an individual basis rather than as a plaintiff or class member in a class, consolidated, or representative proceeding. If this restriction is unenforceable for a particular claim or jurisdiction, it will be limited or severed only to the extent necessary.

Changes to these Terms

We may update these Terms to reflect new features, changes to the Service, legal requirements, security needs, payment functionality, or operational changes.

The revised Terms will be posted with an updated effective or revision date. We may provide additional notice of material changes when reasonably appropriate.

If applicable law or the nature of a material change requires renewed consent, we may require you to affirmatively accept the revised Terms before continuing to use affected portions of the Service.

Changes apply prospectively unless applicable law requires otherwise.

General terms

• Entire agreement. These Terms, the Privacy Policy, any checkout-specific disclosures, and rules expressly incorporated by reference constitute the agreement governing your use of the Service.
• Order of precedence. Checkout-specific terms control only for the particular transaction to which they expressly apply if they conflict with these Terms.
• Severability. If a provision is determined to be unenforceable, it will be enforced to the maximum lawful extent or severed while the remainder continues in effect.
• No waiver. Failure to enforce a provision on one occasion does not waive the right to enforce it later.
• Assignment. You may not assign your account or rights under these Terms without permission. The responsibilities associated with Valtheryn may be assigned in connection with a legitimate transfer, reorganization, incorporation, or sale of the Service, subject to applicable law.
• Force majeure. We are not responsible for delay or interruption caused by circumstances beyond reasonable control, including infrastructure failures, cyberattacks, disasters, labor disputes, government actions, widespread network failures, or provider outages, although reasonable efforts may be made to restore the Service.
• Headings. Section headings are provided for convenience and do not independently change the meaning of these Terms.
